1. Acceptance of these Terms

By accessing or using Domain Brokers New Zealand (the “Site”), you agree to be bound by these Terms & Conditions and any additional policies referenced on the Site. If you do not agree, do not use the Site.

2. Eligibility

• You must be able to form a legally binding agreement to use the Site.
• You are responsible for ensuring your use complies with applicable laws and registrar/registry rules.
• We may refuse service or restrict access where reasonably required to protect users or the Site.

3. Accounts, listings, and user content

If you create an account or submit a listing, you agree the information you provide is accurate and kept up to date.

• Listings: You may only list domain names you own or are authorised to sell.
• Accuracy: You must not mislead buyers about ownership, pricing, traffic, revenue, or included assets.
• Content: You grant us a non-exclusive licence to display listing content on the Site to operate the marketplace.
• Security: You are responsible for protecting your login credentials and activity on your account.

4. Fees, membership, and commission

We offer flexible selling options. Fees may apply depending on the service you choose.

• Fees, membership pricing, and commission rates are shown on the Site and may change from time to time.
• Unless stated otherwise, prices are displayed in New Zealand dollars (NZD).
• You are responsible for any taxes that may apply to your use of the Site or any sale you complete.

5. Transactions, payments, and domain transfers

Domain Brokers New Zealand provides a marketplace and brokerage support. The buyer and seller are responsible for agreeing final terms and completing payment and transfer steps.

• Direct deals: If you self-list and deal directly, you negotiate and agree terms with the buyer.
• Brokered deals: If you request brokerage, we may assist with outreach, negotiation, and transfer guidance.
• Registrar rules: Transfers depend on the registrar and extension. Timeframes vary and may involve verification steps.
• Safety: For higher-value domains, using an escrow-style payment process is often recommended.

6. Prohibited use

You must not use the Site to do anything unlawful, harmful, or misleading. This includes (but is not limited to):

• Listing domains you do not own or control.
• Misrepresenting traffic, revenue, ownership, or included assets.
• Attempting to interfere with Site security or performance (e.g., scraping, attacks, malware).
• Harassing other users or sending spam through Site messaging tools.
• Using the Site to infringe trademarks, copyrights, or other rights.

7. Intellectual property

All Site content, branding, and design (excluding your listing content) is owned by or licensed to Domain Brokers New Zealand. You may not copy, reproduce, or exploit Site content without permission.

8. Disclaimers

• The Site is provided on an “as is” and “as available” basis.
• We do not guarantee that listings are error-free, that a domain will sell, or that a buyer will complete a purchase.
• We do not provide legal, tax, or financial advice. Any guidance is general information only.
• You are responsible for due diligence, including trademark checks and registrar/registry rules.

9. Limitation of liability

To the maximum extent permitted by law, Domain Brokers New Zealand will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profit, revenue, data, or goodwill arising from your use of the Site or any transaction between users.

Where liability cannot be excluded, our liability is limited to the extent permitted by applicable law.

10. Indemnity

You agree to indemnify and hold Domain Brokers New Zealand harmless from claims, losses, liabilities, and expenses arising from your listings, your use of the Site, your breach of these Terms, or your violation of any law or rights of another party.

11. Suspension and termination

We may suspend or terminate access to the Site (and remove or restrict listings) if we reasonably believe you have breached these Terms, engaged in prohibited conduct, or created risk for other users or the Site.

12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of New Zealand. You agree that disputes will be subject to the jurisdiction of the courts of New Zealand.
